lLiability to You
Courtney Degnan Fitness’ (Hereafter kown as CDF) total liability for any claim arising out of any order placed by way of the Website, whatever the nature of the claim, shall not exceed the price of the Package/Product(s) supplied by us to the Customer plus any postage charges incurred, but this limitation of liability does not apply to the extent it is illegal, or it is contrary to a provision in any statute, for us to exclude our liability in whole or in part. CDF cannot accept any liability for a failure to comply with specific instructions on the Website, over Email, on WhatsApp or verbally, nor in any brochure issued by CDF (“Brochure”). Customers’ statutory rights are not affected by this statement.
We are not responsible to a Customer for indirect losses which happen as a side effect of the main loss or damage (such as loss of income or revenue, loss of business, loss of profits or contracts, loss of anticipated savings, loss of data, waste of management or office time) however arising and whether caused by tort (including negligence), breach of contract or otherwise.
Ordering through the Website
By placing an order through the Website, you warrant and represent to us that you are legally capable of entering into a binding contract on behalf of the person placing the order and, if you are an individual placing the order yourself, you are at least 18 years old.
Ordering by Email or Verbally
Ordering Fitness Packages either by email or verbally will be considered binding and fall under the same conditions as ordering via the website (See Monthly Fitness Packages and Cancellations below).
Monthly Fitness Packages, Upgrading and Cancellations
You understand that placing an order for any monthly Fitness Package is a monthly contract and will be billed for each month until you cancel such contract. Cancellations must be from an authorised Email or in writing 7 days before the next billing run, failing which the contract will continue monthly until such conditions are met.
If you are already a paid subscriber and wish to upgrade to another plan or wish to downgrade or delete your account, you MUST notify us on email@example.com
If you are already a paid subscriber and you purchase another plan, you will be billed for the additional plan at the intervals you chose – To upgrade or downgrade you MUST notify us on firstname.lastname@example.org
Trade Descriptions Act
We make every effort to ensure that our goods and services are portrayed accurately on the Website but some variations in colour may occur. Image representations of our Fitness Packages, are just that, representations and any items shown therein are not part of the Fitness Packages Service. All measurements are approximate, and we cannot be held responsible for variations in colour and are dependent on the calibration and setting of your computer screen.
Unfortunately, no refunds of any Fitness Package purchase are possible.
